Terms and Conditions

Effective Date: September 22, 2026 Last Updated: September 22, 2026

1. Agreement to the David Stern Jewelers Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of www.davidsternjewelers.com and any related subdomains, customer portals, and online services (the “Website”). They also govern any purchase, sale, appraisal, custom design, repair, or other service you obtain from Carols Fine Jewelry Inc., doing business as David Stern Jewelers (“David Stern Jewelers,” “we,” “us,” or “our”), whether online, by phone, by email, or at our showroom at 21073 Powerline Rd, #37, Boca Raton, Florida 33433. By accessing the Website, creating an account, placing an order, or engaging our services, you agree to be bound by these terms and conditions and by the policies they incorporate. If you do not agree, please do not use the Website or our services.

These terms and conditions incorporate by reference our Privacy Policy, Return Policy, Shipping Policy, Cookie Policy, and Web Accessibility Statement. If these terms and conditions conflict with a specific written agreement, work order, appraisal engagement letter, or receipt you sign with us, the specific written document controls for that transaction.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to purchase from us, sell to us, or create an account. Florida law requires sellers of precious metals, jewelry, and gemstones to be of legal age and to present valid identification, as described in Section 7.

3. Changes to These Terms and Conditions

We may revise these terms and conditions at any time by posting an updated version on this page and changing the “Last Updated” date. Changes apply to transactions and use of the Website after posting. They do not apply retroactively to orders already placed or services already agreed to in writing. Continued use of the Website after changes are posted means you accept the revised terms and conditions. The Last Updated date at the top of this page always shows when these terms and conditions were last changed.

4. Jewelry Store Terms and Conditions: Products, Pricing and Availability

We make every reasonable effort to describe our jewelry, diamonds, gemstones, and precious metals accurately, including metal type and karat, gemstone identity, carat weight, and grading characteristics. Carat weights may be stated as approximate or total weight, and gemstone grades are the professional opinion of our gemologists or the issuing laboratory, such as GIA or IGI, where a report is provided. Photographs and videos are for illustration. Actual color, size, and brilliance may differ slightly because of lighting, photography, and screen settings, and handcrafted or estate pieces may show individual variation.

In keeping with the Federal Trade Commission’s Guides for the Jewelry, Precious Metals, and Pewter Industries, we disclose whether a diamond or gemstone is natural, laboratory-grown, or simulated, and whether it has been treated or enhanced where that is known. Laboratory-grown diamonds, including those in our Lab Grown Studs collection, are real diamonds with the same physical and chemical properties as mined diamonds, and they are always identified as laboratory-grown.

All prices are in U.S. dollars and may change without notice. Precious metal prices move with the market, so items priced by metal content may be repriced often. We reserve the right to correct errors in pricing, descriptions, or availability at any time, including after an order is submitted. If an item was mispriced, we will contact you before shipping to offer the correct price or cancel the order with a full refund. Inclusion of an item on the Website does not guarantee it is available, since many pieces are one of a kind and may sell in our showroom before an online order is processed.

5. Orders, Payment, and Verification

An order placed through the Website is an offer to buy. It is not accepted until we confirm it and process payment. We may decline or cancel any order for any lawful reason, including suspected fraud, inability to verify payment or identity, quantity limits, or pricing errors. Because fine jewelry is a high-value purchase, we may require extra verification before processing or shipping, such as matching billing and shipping addresses, identification, a signed authorization, or a phone call.

We accept the payment methods shown at checkout. You represent that you are authorized to use the payment method you provide. Applicable Florida and local sales tax will be added where required. Special-order and custom items may require a deposit as described in Section 9.

Our price match guarantee applies under the terms we publish or state in the showroom at the time of the request. Price matching generally requires a verifiable, currently available offer for an identical item, including the same metal, weight, gemstone identity, and grading, from an authorized seller. Unless we state otherwise, the guarantee excludes auctions, closeouts, marketplace listings, and advertising errors. We decide whether a match qualifies.

6. Shipping, Risk of Loss, and Returns

Shipping methods, insurance, signature requirements, and delivery timelines are governed by our Shipping Policy. Title and risk of loss pass to you when the carrier delivers the item to the address you provided and the delivery is confirmed. Returns, exchanges, and refunds are governed by our Return Policy. Custom-designed, engraved, resized, special-order, and altered items are final sale unless the Return Policy or your written agreement states otherwise.

7. Terms and Conditions for Selling Gold, Silver, Diamonds and Jewelry to Us

When you sell items to us, you represent and warrant that you are the lawful owner of the items or are legally authorized to sell them, that they are free of liens and claims, and that they are not stolen or otherwise unlawfully obtained.

These terms and conditions for selling gold and other items follow Florida law. As a licensed buyer operating under Florida’s secondhand dealer laws (Chapter 538, Florida Statutes), we are required to verify your identity with valid, unexpired government-issued photo identification, to record information about the transaction and the items, and to take any other information the law requires, such as a thumbprint. This information may be reported to or made available to law enforcement as the law requires. We will not complete a purchase without the required identification, and we cooperate fully with law enforcement on any item suspected of being stolen.

Offers are based on our evaluation of weight, purity, gemstone quality, condition, craftsmanship, brand, and current market conditions, including spot prices for precious metals. Offers are valid only at the time they are made unless we state otherwise in writing. You are never obligated to accept an offer, and there is no charge for an evaluation. Payment is issued only after the evaluation is complete and you accept the offer. Once a sale is complete and payment has been issued, the transaction is final. Items sent to us by mail for evaluation are handled under any mail-in instructions or agreement we provide. You remain responsible for insuring items in transit to us until we confirm receipt.

8. Jewelry Appraisal Terms and Conditions

Appraisals are performed by our G.I.A.-trained gemologists and prepared in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP) where applicable. An appraisal is a professional opinion of value for a specific stated purpose and effective date, such as insurance replacement, fair market value, estate and probate, or equitable distribution. Values for one purpose are not interchangeable with values for another. An insurance replacement value, for example, is not an offer to buy and does not reflect what an item would bring if sold.

An appraisal is not a guarantee of value, an offer to purchase, or a warranty of the item’s authenticity or condition beyond what can reasonably be determined through non-destructive examination. Some characteristics cannot be determined without laboratory testing or removing stones from their settings, and the appraisal report will note these limitations. Market values change over time. We recommend updating insurance appraisals every two to three years. Fees are quoted in advance and are based on the nature and scope of the work, never on a percentage of the appraised value. Your recent appraisal reports will be stored in your customer account on the Website, as described in Section 11.

9. Custom Design, Repairs, and Services Performed on Your Items

Custom design. Custom jewelry projects begin with a consultation and may include CAD renderings for your review. A non-refundable deposit, in an amount stated on your design agreement, is required before production begins. Once you approve a final design or CAD rendering, the design is locked, and later changes may add cost and time. Delivery dates are good-faith estimates and may be affected by stone sourcing, casting, and finishing. Finished pieces may vary slightly from renderings because of the nature of hand fabrication. The remaining balance is due before the piece is released to you. Unless otherwise agreed in writing, original designs created by us remain our intellectual property, and you receive ownership of the physical piece.

Customer-supplied stones and materials. When you provide your own diamonds, gemstones, or metal for setting, resetting, or redesign, you accept the inherent risks of working with them. Some gemstones, including emeralds, opals, tanzanite, pearls, and treated or previously damaged stones, can chip, crack, or change during setting, sizing, cleaning, or heating, even when handled with professional care. We will note visible damage or concerns on your intake receipt. Except where damage results from our negligence, we are not responsible for damage from pre-existing conditions, internal flaws, or the stone’s natural properties.

Repairs and watch service. Repair estimates are provided before work begins. Additional needed work found during the repair will be quoted to you before we proceed. Items left with us are documented on an intake receipt that describes their identity and condition, and you must present the receipt or valid identification to pick up an item.

Unclaimed items. Please pick up completed items promptly. If an item is not claimed within ninety (90) days after we notify you that it is ready, using the contact information you provided, we may charge a reasonable storage fee and, to the extent permitted by Florida law, treat the item as abandoned and sell or otherwise dispose of it to recover amounts owed after giving any notice required by law.

10. Warranties and Disclaimers Under These Terms and Conditions

Warranties on specific merchandise or workmanship, if any, are those stated on your receipt, certificate, or written agreement. Except for those express warranties and any warranties that cannot be excluded under applicable law, the Website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Normal wear, loss of stones due to impact or improper care, damage from chemicals or accidents, and work performed by other jewelers are not covered by any warranty. Our Jewelry Care guidance explains how to protect your pieces.

Educational content on the Website, including our diamond education pages and blog, is general information only. It is not a personalized appraisal, investment advice, tax advice, or legal advice. Precious metals and gemstones should not be purchased primarily as investments based on content from this Website.

11. Customer Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. Your recent jewelry appraisals performed by David Stern Jewelers will be stored in your customer account on the Website, where you can view and download them at any time. Your account may also give you access to diamond grading certificates, order history, and related documents. These digital copies are provided for your convenience.

Keep your signed original appraisal reports and laboratory certificates in a safe place, because the originals control if they differ from the online copy. We may suspend or close accounts that violate these terms and conditions, show signs of fraud, or remain inactive for an extended period, and we will attempt to notify you before permanently deleting stored documents. How we collect and protect account information is described in our Privacy Policy.

12. Affiliate and Referral Program

Participation in the David Stern Jewelers affiliate or referral program is governed by a separate Affiliate Agreement that you must accept when you enroll. The Affiliate Agreement sets out commission rates, cookie and attribution windows, payment terms, and prohibited marketing practices. Affiliates must follow the FTC’s Endorsement Guides and clearly disclose their material connection to us whenever they promote our products or services. If the Affiliate Agreement conflicts with these terms and conditions regarding the program, the Affiliate Agreement controls.

13. Acceptable Use of the Website

You agree not to use the Website for any unlawful purpose or in any way that could damage, disable, or impair it. Prohibited conduct includes attempting to gain unauthorized access to any account or system, introducing malware, scraping or harvesting content or pricing data by automated means without our written permission, submitting false information or fraudulent orders, impersonating any person, or interfering with other users’ access. We may restrict or terminate access for anyone who violates these terms and conditions.

14. Intellectual Property

All content on the Website is owned by or licensed to Carols Fine Jewelry Inc. and is protected by U.S. and international copyright, trademark, and other intellectual property laws. This includes text, photographs, videos, jewelry designs, CAD renderings, logos, graphics, and the David Stern Jewelers name and marks. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content without our prior written consent.

15. Reviews, Submissions, and Communications

If you submit reviews, photos, testimonials, design ideas, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including on the Website and social media. You represent that your submissions are truthful and that you have the right to share them. We will not publish reviews that we know to be fake, and we do not require or incentivize only positive reviews. By providing your phone number or email, you consent to receive transactional communications about your orders, appointments, appraisals, and services. Marketing messages are sent only with the consent required by law, and you may opt out at any time.

16. Third-Party Links and Services

The Website may link to third-party websites and services, such as gemological laboratories, payment processors, mapping services, appointment scheduling tools, and review platforms. We do not control those sites and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

17. Limitation of Liability

To the fullest extent permitted by law, David Stern Jewelers, its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of sentimental value, arising from your use of the Website or our products or services, even if we were advised of the possibility of such damages.

Our total liability for any claim relating to a specific product or service will not exceed the amount you paid us for that product or service. For items left with us for appraisal, repair, or design, our liability is further limited as stated on your intake receipt or written agreement. Nothing in these terms and conditions limits liability that cannot be limited under Florida law, including liability for gross negligence or intentional misconduct.

18. Indemnification

You agree to defend, indemnify, and hold harmless David Stern Jewelers and its owners, officers, employees, and agents from any claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising from your violation of these terms and conditions, your misuse of the Website, or any false representation you make, including representations about ownership of items you sell to us.

19. Governing Law and Disputes

These terms and conditions and any dispute arising from them or from your dealings with us are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty (30) days.

Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts. Either party may bring a qualifying claim in small claims court. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any class or representative proceeding.

20. General Provisions of These Terms and Conditions

If any provision of these terms and conditions is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign your rights under these terms and conditions without our consent. We may assign ours in connection with a merger, acquisition, or sale of assets. These terms and conditions, together with the incorporated policies and any specific written agreements, are the entire agreement between you and us regarding their subject matter. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, hurricanes, carrier delays, supply disruptions, or government action.
